Failure to Provide Required Information in an Advertisement

The Mortgage Company’s advertisements failed to display the required information, including the Texas Consumer Complaint/Recovery Fund Notice (TX Notice). Regulation 7 Texas Administrative Code §80.203(b)(2) states that any advertising of residential mortgage loans or for residential mortgage loan origination services must contain the name of the mortgage company followed by the mortgage company’s NMLS identification number and the name of the sponsored originator followed by the sponsored originator’s NMLS identification number. Regulation 7 Texas Administrative Code §80.200(b) requires the Notice to be posted in a conspicuous fashion on each website and social media site of the mortgage company or sponsored originator. Texas Finance Code §180.151 requires the unique identifier of a person originating a residential mortgage loan to be clearly shown on each residential mortgage loan application form, solicitation, or advertisement, including business cards and websites.
